Plain rules for using ZENME Cloud: it watches your backups and does not replace them, your data stays yours, and you can leave whenever you like.
Agreeing to these terms
These terms are an agreement between you and ZENME (“we”, “us”) about your use of ZENME Cloud, including this website, the waitlist, your account and the dashboard (the “Service”). By joining the waitlist, creating an account or using the Service, you agree to them and to our Privacy Policy.
If you use the Service for a company or other organisation, you confirm that you can bind it to these terms, and “you” includes that organisation. If you do not agree, please do not use the Service.
What ZENME Cloud does
ZENME Cloud shows the backup status of your ZENME Backup installations in one dashboard and alerts you when a backup fails, goes stale or a machine stops checking in. It observes. It does not run, store or restore your backups.
ZENME Backup keeps working on its own schedule whether or not it is connected to ZENME Cloud. ZENME Backup is a separate product and may come with its own terms.
ZENME Cloud has not fully launched yet. Features may change, be added or be removed, and some described on the website may not be available yet.
The waitlist
Joining the waitlist means we will email you once when ZENME Cloud opens. It does not reserve an account, a price, a plan or any other benefit, and we are not obliged to launch by any date or at all. You can ask us to remove your address at any time.
Your account
- You must be old enough to form a binding contract where you live, and at least 16 years old.
- Registration may be closed or limited to invited people. We can decide who may create an account.
- Give us accurate information and keep it up to date.
- The person who creates an account becomes its owner and is responsible for everything that happens in it, including what the other members they add do.
- Keep your password and any enrollment codes secret. Tell us right away if you think someone else has access.
Acceptable use
You agree not to:
- break the law or use the Service to harm others;
- connect machines or data you have no right to monitor;
- try to access other accounts, machines or data, or probe, scan or test the Service’s security without our written permission;
- overload, disrupt or reverse engineer the Service, or get around rate limits and plan limits;
- send malware, or use the Service to attack or spam anyone;
- resell or offer the Service to others in a way we have not agreed to.
Your data
You keep all rights to the data you and your machines send us. You give us a limited licence to store, process and display it only to run the Service for you, including sending your alerts. We do not sell it and we do not use it to advertise.
The Service is built for backup status only. Do not send us database credentials, backup files or other secrets, and keep name hashing on if the names of your databases or projects are sensitive. How we handle personal data is described in our Privacy Policy.
Plans, machines and fees
- A plan allows a number of active machines. Connecting more than your plan allows is refused until you free a slot or change plan.
- If you end up over your limit, for example after a downgrade, we will tell the account owner and give notice before any machine is made inactive. By default the earliest connected machines stay active and the owner can choose a different set.
- If a paid subscription lapses, your machines become inactive and stop appearing in the dashboard. Your local backups are never affected.
- Billing is not live yet. When it is, we will show you the price, the billing period and what is included before you are charged, and we will not charge you without your agreement.
Availability and monitoring limits
We work to keep the Service available and alerts timely, but we cannot promise it will be uninterrupted, error free or that every alert arrives. Alerts depend on your machine’s connection, your email provider and other things outside our control. A machine that goes silent is marked offline, but we cannot tell why.
ZENME Cloud is an extra layer of awareness and not a substitute for your own backup practices. Test your restores regularly and do not rely on the Service as your only way of noticing a problem.
Our rights and your feedback
The Service, including its software, design, name and logo, belongs to us and our licensors and is protected by law. We give you a limited, personal, non-transferable right to use it under these terms. If you send us ideas or feedback, we may use them without owing you anything, though we will not publish your name or data with them.
Ending your use
You can stop using the Service at any time, and you can ask us to close your account and delete its data by writing to [email protected]. We delete it as described in the Privacy Policy.
We may suspend or end your access if you break these terms, put the Service or other people at risk, fail to pay what you owe, or if the law requires. Where we reasonably can, we will warn you first. We may also stop offering the Service, and if we do we will give you reasonable notice.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows. In particular we do not warrant that the Service will detect every failed backup or that your data will be recoverable.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, for death or personal injury caused by negligence, or your statutory rights as a consumer.
Changes to these terms
We may update these terms. The date at the top shows the latest version. For significant changes we will email account holders before they take effect. If you keep using the Service afterwards, you accept the new terms; if you do not, you can close your account.
Governing law and general terms
These terms are governed by the laws of the country where ZENME is established, without regard to its conflict-of-law rules. Courts there have jurisdiction, but you keep any mandatory right to bring a claim in the courts of the country where you live.
These terms and the Privacy Policy are the whole agreement between us about the Service. If a part is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent.
